Terms of Service

1. Agreement
By accessing embersoullabs.com or using EmberSoul Labs products (“Services”), you agree to these Terms. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Services
EmberSoul Labs provides business software including EmberCore ERP and EmberOS. Features, availability, and pricing may change. Products marked as in development may not yet be publicly available.
3. Accounts
You are responsible for safeguarding login credentials and for activity under your account. Notify us promptly of unauthorised access at support@embersoullabs.com.
4. Acceptable use
You agree not to:
- violate applicable law or third-party rights;
- upload malware, spam, or unlawful content;
- attempt to breach security or access data not belonging to you;
- reverse engineer or misuse the Services except where permitted by law;
- use the Services to send unsolicited marketing without consent.
5. Customer data
Business customers retain ownership of data they submit. We process customer data to provide the Services as described in our Privacy Policy. Customers are responsible for having a lawful basis to collect and share personal data they enter into the Services.
6. Intellectual property
EmberSoul Labs and its licensors own the Services, branding, and software. We grant you a limited, non-exclusive licence to use the Services according to your subscription or agreement. You retain rights in content you upload.
7. Fees, subscriptions & Stripe billing
Some Services (including EmberOS) are offered on a subscription or usage-based basis. When you sign up for a paid plan, you authorise us and our payment processor Stripe to charge your chosen payment method on a recurring basis until you cancel.
- Plan names, prices, currency, trial length, and included usage are shown at checkout or in your account before you subscribe.
- Unless stated otherwise at purchase, subscriptions auto-renew at the end of each billing period at the then-current price.
- You may cancel through your account settings or Stripe Customer Portal where available; cancellation stops future charges but does not retroactively refund the current period unless required by law or explicitly stated.
- Fees are generally non-refundable except where required by Malaysian law or where we state otherwise in writing.
- We may change pricing with reasonable notice; continued use after the effective date constitutes acceptance of new pricing for renewal periods.
Free trials or promotional credits may be offered at our discretion and may convert to paid plans unless cancelled before the trial ends.
8. AI-generated content (EmberOS)
EmberOS uses automated and AI systems to suggest edits, captions, scripts, and video outputs. Such outputs may be inaccurate, incomplete, or unsuitable for your jurisdiction or advertising platform. You are solely responsible for reviewing, editing, and approving all content before export, publication, or client delivery.
You must not use the Services to generate or distribute unlawful, misleading, infringing, or harmful content. You retain responsibility for compliance with advertising standards, platform rules (e.g. TikTok, Instagram, Meta), and applicable law.
9. Disclaimers
The Services are provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by Malaysian law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, EmberSoul Labs shall not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or the Services shall not exceed the fees you paid us in the twelve (12) months before the claim, or MYR 100 if no fees were paid.
11. Termination
We may suspend or terminate access for breach of these Terms or to protect the Services. You may stop using the Services at any time. Provisions that by nature should survive (e.g. liability limits, IP) will survive termination.
12. Governing law
These Terms are governed by the laws of Malaysia. Courts in Malaysia shall have exclusive jurisdiction, subject to mandatory consumer protections if applicable.
13. Changes
We may update these Terms. Continued use after the updated date constitutes acceptance of the revised Terms.
